I searched forum, but i decide to ask you guys anyway.
I came here at age 12 in 1997 with a visitors visa, overstayed and i am currently undocumented. I studied architecture and graduated with a bach. of architecture design professional degree (5yr program). i'm wondering if i am eligible for some type of visa if i can find a company that will sponsor me? .. i came here with my brother. Parents weren't here so i don' think i'm eligible under 245i and never filed any type of USCIS related stuff.
is there any way to become legal? if i find a company that can use my skills?
or only way is to get married to USC and Dream?

I'm so sorry. There is no way for you to pursue your professional degree in US unless you marry a USC. I'm in the same position as you except I've been here since the age of 10 in 1999 and I have IT degree. You also can't join the military because it's hard enough for those with temporary visas to join the army.

I just want to let you know these facts ahead of time so that you don't fall into victims of brokers who says otherwise.

Another bad news is, if you're over the age of 30 by 2012, you most likely won't be qualified for Dream Act even if you wait till 2013 because the last version of Dream Act of age limit 29 didn't pass 2 weeks ago and I don't think age limit will become wider if not narrower.
Also, if you leave US now, you can't come back to US for 10 years.. I personally think the best option for us is to go back to our country and immigrate to Australia or Europe.

CIR isn't going to pass until 2013. Even if you wait until 2012 election, there is no guarantee that Obama will become re-elected and even if Obama becomes re-elected, there is no guarantee that he will pursue CIR because Obama promised to pursue CIR in 2008 but haven't done anything until the very last chance that he has to pass an easier bill "Dream Act" and he failed. This trend will repeat in 2013. Even if he Obama pursues CIR, it's unlikely that Dream Act or CIR will pass the senate and/or house because last Dream Act barely made it through house and didn't even pass senate with democrats majority. CIR will be harder to pass than Dream Act.

I don't want to get your hopes up, but I know this guy who is a nurse, graduated the program, got an interview to work at a hospital, was undocumented and knew he didn't have a chance but he dediced to go anyways, and then got told the hospital was going to sponsor him to try to get him a visa or some status. True story. So I think there could be a chance.

You are right about this. Like 4 years ago when there was a major nurses shortage in the US, nurses from different countries were being imported here, even illegal ones here got a workers permit to work in the USA. A friend knows someone who was illegal, parents took out a double morgage (Just to pay for her private school education) and the school petitioned on her side to work for a private hospital. Now shes legal!

Thats what Im planning to do if the DreamAct dont pass. I will get my BSN, then with the help of my school, get petitioned for a private hospital. You guys should think of nursing also since Its a likely chance to get a Nurses green card as the babyboomers become older and great pay!

There is some setbacks, most states dont allow illegals into nursing school. You got to dig deep and do some research!

If you're going to apply for a new visa you will have to do so in your country of origin. However, as iNeverHadAChance wrote in his post, you won't be able to enter the US again for 10 years (more than 1 year of illegal presence = 10 year ban) once you leave.

You can however apply for a non-immigrant waiver of inadmission. I'm still doing research on how successful such applications are: http://usvisasolutions.com/I-601-imm...n-waivers.html

Did she have to return to her country of origin in order to adjust her status, or was she able to stay in the US for the legalization process?

Aguilan did you read the link I posted? You dont have to leave the US in order to obtain a "nurses green card".

Nope she didnt have to return to mejico, all done here in the US

it's possible, i've got an opportunity to teach in HS, I think it depends on the immigration worker and how it's reviewed on a case by case

Already working on my PhD in another country, but my siblings might find this info useful since they're still in uni and are applying to nursing school.

I've read about adjusting under 245(k) but from my understanding, that's only possible when the applicant has been out of status/overstayed for less than 180 days. I wonder what other waivers or other documents your friend filed for- that's why I asked whether she had to leave or not.
