I hate to say it,but what deterrent would there be if the bar was not in place ?Wouldn't there be effectively more visa overstays and a higher illegal entry rate ?

What is needed is not an end to the bar,but waivers for those whom have entered illegally as most aren't covered under 245i.Visa overstays have at least US citizen immediate relatives. We have a Democrat in the administration whom was supposedly pro-migrant but obviously that has not been the case,it all comes down to the President or Secretary of State for anything to be possible.

Back then, the bar was only effective for 5 years max. I believe with 245i enabled prior to the 1996 act coming into law.

The bar only applies to Overstays. It does not apply to EWI's. Visa Overstays have GC/USC parent(s) and sibling(s) but you still have to leave USA for 3/10 years unless there is some kind of 'Waiver' that will grant the overstay person to stay.

245i applies to Overstays and EWI's.

^^If it applies only to overstays then why are so many EWI's still in the US and are concerned about leaving the country ? Your second comment is somewhat inaccurate.

It is pretty clear you don't understand what the laws are,but at least you got the 245i statement right.Try to learn INA.

My question is to you that what in the world would make you think you would be allowed back, ban or not.

Is there any way we can legalize ourselves besides marrying USC?
I don't want to get a free ride. I just want to work my way to become a productive member of this society, but current law won't let me be.
Only way is to go back to my country and face 10 years ban. And then file for immigration, which will never happen. I have a relative, who got banned from US about 20 years ago, and trying to come back to this country. His son served in US Army, but his visa does not come out because of his past record of ban. Only way he can see his son is the son coming to visit him.
My concern is if I leave, there is no guarantee that I can come back after 10 years.

Why would EWI Dreamers go back? They were raised here.

So you're saying only Dreamers are EWI's ? I'll say it again, you should read up on what the law actually says.

Immigration bars are dictated mainly by the unlawful presence in most cases concerning the undocumented.Unlawful presence IN the US is NOT dictated by entry !!!!!!

Right. It doesn't matter if you are EWI or an overstay, if you were here illegally for a certain period of time, you get a ban. Simple.

Either way there is a ban however there is a BIG difference. If you EWI and marry a US citizen you cannot adjust in the country you have 10 year ban if you been in the US for over 1 year. If you overstay and marry a US citizen then you are forgiven - NO BAN - you can adjust inside the country.
