So im an overstayer and im thinking about going back to England. I love the US and ive been here since i was 7, but ive reached the point where im done with living like this.

After the ten year ban is over, will it be difficult to come back? My bro will hopefully be US citizen in a few years. Will he be able to petition for me if i decide to comeback after the ten yeas? Even if he can't petition for me, will it be difficult for me to visit him after the ten years?

What i hate about this whole situation is that if i leave, i won't get to visit my bro for ten years. I'm really close to him and just thinking about it makes me tear up. It sucks that i have to think 10 years in advance.
Man, i really get excited when i think about living in England. But then i think about everything(family/friends and culture) ill be leaving behind and all the excitement is gone.

I haven't talked to my lawyer about this yet, because im not sure how serious i am yet. I figure i come here and ask what you guys know about the ban.

Thank you.

Thats a hard decision to make, surely or more of us would do the same. I can't say much since I've never been to England so I dont know what will be missed or loved, and being close bro's an all that tough. Do what you have to do to make your life better, just think of how you can succeed with that and go for it... takes courage whatever you do.

Good luck!

I would go back and get with Keeley Hazell.

I think it shouldn't be too difficult because the 10 year ban is a hefty penalty. Either way, I think the best option would be asking your lawyer. Good luck

As soon as he turns 21 years of age,you should have him file an I-I30 that will be the issue. It takes ~11 years total to process anyway.A visit visa will be hard to justify with any consular official if you have previously overstayed and you're also permanently barred from using the VWP program and a B2 visa is required, this is all after the 10 year bar that is.

It does, have him file an I-130 immediately then.Obviously,it will take the entire process ~11 years to complete.
