You can't "file" for 245i because it isn't an application. It simply means that someone filed a petition i-130 (family) or i-140 (job) for you or for one of your parents before April 30th, 2001.

Do you or any of your parents have a i-130 or i-140 petition?

Can a US Citizen mother file for her 21 and over son and unmarried through 245i now? Note : The mother a GC Holder well after the April 30th 2001 deadline.

Without serving the 3/10 year bar.

What if an employer filed the labor cert before that date but never got approved?

I think there is portion on there that talks about approvable on the filing?

It depends on why it wasn't approved. "Approvable on filing" means that you filled out everything correctly and that you actually qualified for it at the moment of filing (aka the application was legitimate).

If it was later not approved for another reason (a year or so later) you should still qualify. The language leaves room for ambiguity but I think that's how people interpret it.

A reason would that the company could not afford the potential filer to work there.
