wow there's that much of a difference when it's a green card holder? so basically you're saying there's no point to that if you can't even get work authorization for 4 years. And no point in sibling sponsoring either. This sucks.

Pretty much,but I believe you might have misunderstood what I wrote.I am saying someone can't adjust on US soil filing a petition today through a permanent resident spouse or US sibling relative.The adjustment interview cannot be done on US soil.

unless it's under 245i meaning you have a pending/denied application from before 2001 right? like if my parents did one?

also, the adjustment interview CAN be done on US Soil if marrying a USC only, right?

Exactly,or what is called the grandfathering clause under 245i for any immigrant petition which also would has to be proven !!!!

Correct,and if the person overstayed or are under 245i.

thanks for your help. I get it now. Basically, all I have is the Dream Act or get really lucky and meet the right guy who just happens to be USC. Dream Act seems much for likely LOL.

I am about to start my immigration process on thursday. I will be handing my lawyer a 420 dollar money order for the spouse petition and a 500 dollar deposit. Me and my wife got married monday may, 25-2011. I am an EWI, entered in 1992 at 2 years old. So I'm most likely leaving the country to adjust. What are the average timelines for my case? I'm from mexico and my wife is a natural born U.S Citizen

get to know his favorite underwear color, his favorite color, his favorite sex position, whether you had sex the night of ur marriege( i know someone that got denied bc of this), favorite food, place etc... if you don't know these things... well yeah.

Before answering your question,do you know the process you're about to go through ?

I think the timeline is irrelevant until someone has a firm understanding what they are about to undertake.I also highly suggest going to the website Immigrate2us.net for further inquiry on this situation.

I'm pretty sure of what I'm about to go through. I will file my i-130 on Thursday. From there I will wait for my NOA1 saying my petition has been received, and then my NOA2 saying it's been approved. Hopefully. Then on to receiving a visa number.

Have you already gotten your "extreme hardship" information finished as it pertains to your wife for the I-601 ?

The timeline appears to vary but if everything goes ok 1-3 years appear nominal.
