Yes it makes an enormous difference under immigration law. Entering without an inspection is a crime, albeit a misdemeanor for the first offense (second try gets bumped to a D felony if I remember correctly). The act of being in the country illegally is only considered a civil offense, which does not constitute a crime, and as such there can only be civil penalties (fines but no jail time) imposed. Consequently, overstaying a visa usually does not prevent you from adjusting your status in the US.

US actually takes this very seriously, because getting in without clearance presents a huge security risk, especially in this day and age, and they cannot really say "well, you got, and its our fault for not catching you so you're good". They kind of make this hang over your head for the rest of your life, and make legalization extremely difficult just to prevent people from attempting it.

Ironically enough, getting through customs with a fraudulent identity (someone else's passport etc.), despite it having much harsher consequences if caught, usually permits a waiver of inadmissibility if someone marries a US citizen (or even PR but that has its own hoops that one needs to jump through).

You theoretically could but you would still be hit with the 10-year ban, and they only lift these for people in special circumstances (i.e. your spouse is sick and you need to take care of her, she is disabled and you're the breadwinner etc. I think you get the point, but simply put they make it very hard for you.).

I'm sorry to ask so many questions, but I haven't really ever tried to fix my status. My parents were always the ones who did that, and now I'm doing things on my own.

yes that makes all the difference in the world... in fact... we wouldnt be talking about it since i would of had my stuff by now.

im bar for 10 years if i leave. no difference if i marry after.

no problem... ask away... that was my biggest problem... i let my parents do everything... and they got bad advise... they field and never named me as a person to get benefits from their applications... so everything they did before april 2001 doesnt count for me... and because of that april i was 22 i was an adult so i got screwed... if i would of taken at least some action before i was 21 i would of been ok. its the reason why my brother got his stuff... he was 1 month away from being 21 so he qualified... but not me... word of advice... dont let your parents do everything... make sure your listed if they are filling and make sure you are gonna get benefits from those applications. (not that there is anything right now for people in my situation but your may differ). Your not gonna believed but on sep of 1993 my parents had temp res all they had to do was adjust status and the whole family would of been ok... they didnt know that they had... they thought it was just a work permit... they let it expired... and never filed before the extension in 98. I always trusted them to have been making the best decision when i should of looked out for myself... my parents made many mistakes which now im paying for them... i dont blame them... i understand why they did what they did and why... but it doesnt help me or my family now...

The law is so unfair.... they treat people like use like we are criminals... rapist, killers, drug dealers... yet we have dont nothing wrong than to be dragged into this country without use having to say anything about it... Can you blame an 8 year old for doing what his parents wanted to do...?

I live in Connecticut, I honestly don't think we would ever get a law like this. If it did happen though I'm not sure what I would do because I'm the type of person who would have to be in the situation to see how I would react. However, It would suck to have to move out of state and start all over again .

According to some hardcore Republican senators, American culture also involves English and only English. If you make even the slightest mistake, I would expect them to toss you out of the window.
