I'm an independent contractor and I filled out the W7 and got an ITIN already. I just got my EIN. I used my ITIN and EIN on the W9 form...

What did you claim yourself as when your apply for the EIN?
It should be sole proprietor.

On W-9, it says that under the penalties of perjury you promise that you are:

3. A U.S. Citizen or a U.S. person....

How are you going to be able to sign it without lying about your status???

There is more though:

3. I am a U.S. citizen or other U.S. person (defined below).

Definition of a U.S. person. For federal tax purposes, you are
considered a U.S. person if you are:
• An individual who is a U.S. citizen or U.S. resident alien,
• A partnership, corporation, company, or association created or
organized in the United States or under the laws of the United States,

• An estate (other than a foreign estate), or
• A domestic trust (as defined in Regulations section 301.7701-7).

I'm sure we all know the intent of the questions, but apparently a partnership, corp or company also qualifies.
