Presence in the United States since childhood; AND active pursuit of higher education are two of the 19 factors listed in the morton memo for determining whether or not a case should be considered"low priority". Which means that the other 17 factors may cover immigrants who would not have been Dream Act eligible.

It is important to note, however, that the announcement only talks about the 300 thousand pending removal cases. If you are not one of those 300k, you will not be able to just go and apply for a Work Permit. This was just an announcement. How they implement this policy is yet to be seen. There will be a lot of scam artists in the meanwhile, praying on desperate immigrants. Don't act on any advice unless it comes from an experienced Immigration Lawyer.

^ I really doubt that this would ONLY benefit those 300,000 cases. Future cases will also be covered.

yea i think this will only deal with the already pending cases. obama doesn't have the power to grant 11million or so work permits unless it goess thru congress. he's just relieving whats already under the table, and to even things out the amount that was deported under his power. plus get some votes from latinos.

Well you never know, sure 11 million or so work permits sounds ridic but hey slap on a fee or fine for that 11 mill and maybe it will be less hated.

But then again.......lol

They're applying the same criteria to future cases. Napolitano mentioned it in passing in her letter to Sen. Durbin:
