Damn, it was my only other hope. Now I truly am at the mercy of the DREAM Act.

What is the average timeline for a USC Parent petitioning for her overstayed son that is over 21?

Overstayed doesn't particularly make a difference except that, under current law, the son can't adjust status unless the petition is under 245(i).

There are 271,018 people on the waiting list for the F1 category as of October 2010 and the visa limit per year is 23,400 plus numbers not required for F4. Given that F4 is never empty, that means an average wait time of 11 years and 7 months before the entire waiting list as of October 2010 is completed.

Lets add the 245i petition also into this. Where did you get this stat? This is in real-time/

Will they add more then 23,400 in the future?

This is the most recent data:
http://travel.state.gov/pdf/WaitingListItem.pdf

The 23,400 is fixed by INA 203(a)(1). In order for that number (or any number) to be raised, Congress will have to amend the INA.

Everyone needs to keep in mind that the process between an Overstay and a EWI is completely different. The process between a LPR Spouse to USC Spouse is obviously different.

thank god for this forum....i was going to make a mistake and get married to a green card holder just for papers. I think one needs to fall in love or like that person...so one day u wake up and have no regrets.

Yeah,like immediately and 3 years seems to be quite a bit of variation.

Glad people are taking the initiative to understand though,it makes a world of difference and it shows versus the previous generation of immigrants I think.
