Correct me if I'm wrong, but I thought if you were designated an immediate relative (parents, unmarried son or daughter under 21, or spouse) you didn't have to leave the US (at least for those who are visa overstays). If that's the case, then wouldn't the ban waivers being completed in advance help EWIs and married sons or daughters of USCs over 21?
I agree with you, immediate relatives of USCs that overstayed their visas don't need to leave the US to Adjust their statuses, maybe I misunderstood the proposal, but so far, I believe that the proposed waivers are supposed to help EWI US Citizen immediate relatives, I doubt that it will help the married sons and daughters over 21 of USCs since they're not immediate relatives. I may be wrong though....

You are correct. Unmarried and married sons and daughters over 21 of USCs do not count as immediate relatives and cannot take advantage of this waiver.

Thanks for clearing that up, Swim.

If Rubio follows through with this, it will be political suicide. No matter what the details of the bill are, for instance, a visa with no path to permanent residency or citizenship, it won't matter to the far right, who will froth at the mouth and scream the worst word in the English language, "AMNESTY." He will go down in flames, like George W. Bush when he pushed for immigration reform.

Mitt Romney will then pick somebody else as the vice presidential candidate, then lose in the general election, but the Democrats won't have enough votes in the Senate to ever pass anything like the DREAM Act, and life for us all will go on as it always has been. Mark my words.

Did you leave the US? If so, don't worry about it. If you are still here, what are you doing here if the future is grim?

Or am I asking for too much?
The 3/10 Bar only applies if you leave the USA. Lets say the bans are removed and you return to your country and get denied of any kind of Visa then what?

You can easily adjust your status if your parent is a USC and under 21, spouse USC. This comes under immediate relatives and it does not take that long.

What about a USC parent who has a Dreamer Son/Daughter unmarried over 21? I know they have 'F1' category but it still takes over 5 years for the Visa to become available.

The extreme wing of the republican party, those that think Obama is a Kenyan born Muslim, would rather vote for a pro-immigration Romney/Rubio than re-elect Obama. Poll after poll has shown that a majority of Republicans support some type of Immigration Reform. So, I don't think it will necessarily be political suicide for Rubio to support Dream Act.
