i am 23 dreamer but i carry a burden that has affected from qualifying for the work permit and will continue to affect me in my pursuit for legal status and most likely the rest of my existence about 2 years i was arrested for a DUI 3 months after that at court i was given a plea bargain for wet wreckless which is wreckless driving alcohol related which is a lesser misdemeanor offence than a DUI but is still a misdemeanor i was given this for having no criminal history and because my BAC was .O8.

now my question is should i still try to apply for the work permit? If i get a lawyer will it help my chances of qualifying for the work permit? and also im planning to get married to my gf of 7 years in December what are my chances of of reaching some type of legal status by marriage with this on my background?

and umm don't get me wrong i have accepted the hard truth of my mistake but i still wonder and definitely still dream.....

People deserves a second chance. You could've hurt someone with your driving under the influence, but you didn't and you should be thankful for that.

Seek legal advice from a good lawyer and look into your options. I hope you get it as well.

Talk to a lawyer - a good one. DUI's are something that the public has very little patience with even for citizens but for those with green cards, it can be a deportable offense depending on who's prosecuting and how bad it was which yours may not be given the .08.

The classic trap is non-citizen gets DUI arrest and at first it's not too bad so they take the plea bargain that gives them a big fine and a little community service but otherwise they get to keep their license and have to stay out of trouble. Then a few months later they get a knock at the door from ICE telling them they have been convicted of a DUI and are put in deportation proceedings. "But it was only a misdemeanor and I paid my dues!", but in ICE's point of view something like a DUI is just as bad as a felony.

I don't know what happened the first time or who your lawyer was but I hope he had that in mind. Most don't. So again, talk to a good lawyer (as in someone who doesn't advertise on TV with "AVAGADO! AVAGADO!" flashing on the screen. This is your best chance so I'd at least try.

With me, I came here in the 6th grade back in 1986. Around 7th grade it looked like our case was not looking too good so my relative that I was staying with had a sit down with me and told me the "dog story" of how even though I feel like I belong there and part of the American family, I'm more like their pet and they can kick me out any time they want (I mentioned this story a few days ago). He also told me to not do anything stupid like get in a fight. That stuck with me for 26 years.

The worst thing I ever did was shoplift some beef jerky once from K-mart back in 1987 and kind of got busted and immediately realized the terrible mistake I had made how I completely put myself and my family at risk. Fortunately the guy working security was cool and didn't call anybody but the shame was overwhelming.
