Currently under family's i-140 petition...

So I am currently under my family's i-140 petition for Alien worker which we had to refile years ago because the original fell apart. That caused us to restart the whole legal process in which we technically had no status except SS cards from the first filing. As it stands, a worker permit is supposed to be issued by next year as a part of the i-140.

Is there any way the new proposal may mess up this filing if I go ahead and apply for a work permit?

As far as I'm concerned, the i-140 is slated to give me a green card and everything within the next 5 years if everything goes right. I just don't want to mess this process up just for a work permit that I'll get within a year or so.

Thoughts?

I came to that conclusion as well...I just thought I could get a hint of what is to come from the more knowledgeable people here.

Then again, more details are supposed to come out as the weeks pass. I guess it really is just the waiting game for those 60 days. :P

I-140 is a employer sponsor petition. I-130 is the family. Good question but I don't think it will because one is a employer petition and the other is temporary work permit granted by DHS. Check with a lawyer.

I-140 leads to a GC and the current DHS policy does not. If you had to cancel your I-140 application because of the current DHS policy then I would wait 1 more year. In my opinion, it is well worth that 1 year wait to get a GC. Are you also under the 245i?

The only thing you can do is wait because it really all depends.I KNOW that someone mentioned that the Deferred action paperwork being issued under these new guidelines would not come in association with a Notice to Appear but I think you should wait on clarification on if that is honestly true when someone applies or it could mess up whatever process might you might have for yourself.

All I know is you can have multiple petitions going and it would still be legal.

So my dad consulted a lawyer online which claims that it would not have any negative repercussions on the current process that my family is in.

I'm definitely going to keep my eyes out for more information.

Im on the same boat man. My parents filed I140 and I485 concurrently 12 years ago and the I485 was denied 2 years ago. We are in that no legal status zone right now but we know that we can fix it but it'll just take some time. I really want this work permit soon instead of a uear but I was having the same thoughts as you.

I know that feel bro. It was shocking when I found out I wasn't currently legal since we did everything right in terms of legal immigration.

Hopefully this will smooth over with more info being released in the coming of weeks.
