If it makes you feel any better, the 2010 Dream Act specifically chose to omit section INA212A6c as a reason for not qualifying for a temporary residency. That section is on falsely claiming citizenship and using false documents.

If Obama is as realistic as the Dems who drafted the bill, he'll hopefully make this an excusable offense as well.

I'm glad

Just to back up my statement: http://thomas.loc.gov/cgi-bin/query/...1BTpPLa:e3831:

"(1) IN GENERAL- Notwithstanding any other provision of law and except as otherwise provided in this Act, the Secretary of Homeland Security may cancel removal of an alien who is inadmissible or deportable from the United States, and grant the alien conditional nonimmigrant status, if the alien demonstrates by a preponderance of the evidence that-
(C) the alien--
(i) is not inadmissible under paragraph (1), (2), (3), (4), (6)(E), (6)(G), (, (10)(A), (10)(C), or (10)(D) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a));"

See how 6(C) is omitted?

Under INA §212(a)(6)(C)(i), an alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or entry into the United States or other benefit provided under the INA is excludable.
Under the new INA §212(a)(6)(C)(ii), any alien who falsely represents, or has falsely represented, himself or herself to be a citizen of the United States for any purpose or benefit under the INA or any other Federal or State law is excludable.

willfully misrepresenting a material fact: Hopefully this part would take care of me working once with a slightly modified version of my name. Sigh this is what worries me the most.

I am trying to be optimistic though :

Thanks for your post. It makes me feel better.

Be optimistic. This is all we can do at this point!!! Lets wait for the details. I have hope that the system in place will be fair. Guitierrez and company will fight for us.
