Just getting married isn't enough. You have to prove hardship to get the waiver.

Yeah I understand what you mean. But my question is, we are going to have legal status because we are going to have EAD. Why would we have to leave the country? wouldn't it be the same as an over stayer filing for green card or someone that has a visa? If an over stayer or visa holder married a US citizen he/she can file without leaving the US. So i am confused as to why they would make us leave the US if we are technically going to have legal status. It doesn't make sense to file for a waiver

I believe it is because we only have 'legal status' in the sense that we can't be deported and we don't accrue more illegal presence...but it doesn't erase the time you already accumulated as undocumented. If you entered EWI, you still are (which is why you'd need that waiver). If you leave the US, you'd still be subject to ten year ban, etc.

CT does accept EAD to obtain DL but according to the website it says that if your legal presence is less than a license term they cannot issue you a verified drivers license. I dont know what that really means. EAD will be valid for 2 years and a term for a license is 6 years. So i guess that means we wont be able to get a DL in CT. Who knows, maybe they'll change that or they can at least issue us a DL for 2 yrs.

Im sure you will be able to get a drivers lisense in all states!! I asked laurel again and she said yes!

I am actually going through the waiver process right now. I have an approved I 130 and have stalled movement at the NVC because we decided to wait until the provisional waiver program is implemented. Because I entered as EWI and I acquired unlawful presence after 18 yrs old I still have to leave the country for my visa appointment abroad. Proving hardship when your only addmissabily is illegal presence is not as hard as some of you guys might think!! I would just suggest getting an attorney that is experienced in that field.
