Well either way this is going to end one identity! Either you apply for the Deferred action paperwork under the birth certificate name and gain access to an EAD possibly and give up the ability to ever adjust through an immediate relative in the US since you will be considered an EWI or vice-versa!


If someone from an embassy officially from my country told me that I didn't exist in their system then I would officially be Stateless!It is also well known that quite few visa fraudulent rings exist in India so the birth certificate can even be faked!If you came in on fraudulent documentation [passport and visa] what makes you think that everything else could not be as well?Just because the name is different?

I have already... They're not going to help me as I don't have any legal status.

Well I have never used the other identity after coming here so I don't have any school records with that identity. All my school records are under my real name. I can just say I'm an EWI, and I'm 245i eligible under my parent's so it shouldn't really be a problem in the future, right?

Ianus, I really don't know man... I mean I know my parents are my parents, and thats pretty much all the birth certificate says. Theres no way to verify if its fake or real, ya know? I believe my parents lol

but should I try getting the washington ID? The embassy considers an EAD card as a visa/legal status... so i might be able to get my passport after the EAD:

What are the requirements for obtaining a passport for the first time from the Indian Consulate? Have you looked them up online? What are they?

ALL Consulates get approval from the main Consulate at the home country at the end of the day, it's normal. As long as you have a birth certificate, I'm sure that the consulate can authenticate it by checking the Birth Registry in the home country. As long as your birth was recorded in the Birth Registry of your home country, you should and DO exist.

You probably need to change your approach, just focus on the requirements for getting a first time passport.

Also, the job of your home country's embassy is not to chastise/scold you, their job is to help you get what you need from your home country.

The embassy’s not really willing to help me at all since I don’t have any legal status or proof that I left the country legally. I’m not really worried about filling out the deferred action part because I think the birth certificate should be enough to prove my identity. I’m only worried about the Biometrics part for the EAD and whether I should put EWI on my application or visa overstay… If I put overstay, they would ask for my i-94 (which I have but its not in the right name :/).

One of my friends told me to try getting a Washington ID card. Is this my only option?

If I was you, I would move to washington, or New Mexico. They only ask for translated Birth Certificate, and proof of residency to get an ID! Ive done it in New Mexico IDK about Washington.

Ok find the nearest consulate and go there with your BC and your school id to get your passport.. YOU SHOULD ALWAYS BE HONEST WITH USCIS.. say you do apply and you put EWI on the forms then later on you can adjust aka by marriage or something then you're screwed because you're going to want to put overstay without leaving the country but you already lied on previous forms.. do you get it?? please consult a lawyer

huh? He entered the country on fraudulent documents, in other words he entered without inspection. He will have to leave the country in the future if he want's to adjust via marriage.

Technically, I guess you were inspected by immigration officials when you entered the country. But since the documents were fake, you were never legally admitted into the US, which is what differentiates overstays from EWIs.

Would you then say that you used a passport that didn't belong to you to enter, or do you just say EWI?

Now, people from Latin American can claim they just crossed the border. I suppose those from overseas can claim the same thing (going to Mexico first, then cross to the US), but it seems your consulate assumes that you had to use a passport to arrive here by plane or boat.
