Two days ago i sent an email to a very involved activist in my former Cal State Long Beach. She has tremendously volunteered to attend immigration meetings, has written books that help undocumented students apply for internships, scholarships, let's just say that she is very involved in the movement for a long time. well, her response made me think. i'll post it. please comment:

ME

Dr. E.M., i hope you remember me i attended cal state long beach for my undergraduate degree. I am contacting you to ask if you know any immigration attorneys that you can recommend just in case i need one for the new June 15 differed action memorandum. I meet all the requirements and i am still unsure whether get an attorney or not. I just want to be prepared in case i do.

SHE

HI EG. The information will not come out until mid august, so it is early to get an attorney. I would suggest that when it does come out that you talk with Dr. Nelly Paredes-Walsborn of the 605 Citizenship Project. Her telephone is 209-848-096 and her email is [email protected]. After you speak with her you will be in a better position to determine what kind of attorney you will need. She is also closer to the list of attorneys that work expertly with BCIS. For now, we are advising students to wait until after the November elections to see the outcome. If Obama wins his Executive Order will stand, but if Romney wins it is likely that he will cancel the Executive Order.

The sole fact she calls an administrative action by DHS an executive order makes me question her credibility. If Mittens will win it's most likely we'll keep the EADs until they expire, USCIS and DHS likely won't feel like doing more work again.

#Edit:
Also the reason that this is not an EO means that the following Secretary of DHS can just end it.

If he wins, YES he can definatly over turn obama policy if he wants to, but looking at his another term and latino population, how dare him he can do that.

And the people will judge Mitt Romney accordingly! Don't be afraid to apply, be more afraid of what can happen if you don't.

I think her advise for you to wait to apply is pretty bad. It would be a huge mistake for you to wait to apply. There are so many downsides for you, if you choose to "wait" to apply. No matter who wins the election, you need to receive your EAD. It's a much bigger gamble if you wait until November. Once we receive our documents, it would be much harder for them to cancel them. Instead what would happen is that we would not be able to renew them.

Anyways, I don't think Romney would touch us, he knows that would be playing with fire. I am calling Romney's bluff on this one. Deep down inside Romney knows he can't kick us out to the curb without it causing a big backlash against him. Just like any other politician he is saying these things to appease his party.

PS: Not knocking on you... but you should use spell check before sending an email to an important person like that :-p

Guys please apply for deffered action if your qualified for it. Even if Romney wins election and he overturn this policy, it will not put you in removal process.

Remember that Inauguration day is Jan 20th. That means that you have plenty of time to get the EAD/driver's license, etc cards even if all things fail.
