Anybody Apply With A Misdemeanor?

Congrats on everybody who is receiving their Acceptance's!! Just out of curiosity, has anybody actually filed their application with a misdemeanor (i.e., DUI)? I know these questions are definitely tiresome, but since the only blemish I have on my record is 1 misdemeanor DUI, I was just wondering if anybody actually went ahead and filed an application.

Talk to a lawyer, but a DUI is a disqualify misdemeanor. DO NOT APPLY talk to lawyer first. Good luck you are going to need it.

Yeah, I am definitely going to consult a lawyer regarding my case prior to applying. I got this DUI about 2 years ago and haven't had a run-in with the law since. I also volunteer with a local non-profit providing rides to people who are under the influence, and drive their vehicles home for them. So I was just wondering if I would qualify by any chance, since they would basically exercise prosecutorial discretion, taking into account my application in its entirety. Just thought I would get some feedback, seeing if anybody did in fact apply with a misdemeanor.

Dui = serious misdemeanor with uscis. That's on par with a felony to them. “ definitely talk to a lawyer. A few lawyers actually. It's definitely a serious charge with regards to daca.

Yes, I would hold on on that one. If you qualify for a greencard then your chances are higher. But for DACA purposes, it has been stated that it will disqualify you.

I do not think they will deport you but they will have all your info.

Yeah absolutely, I also highly doubt they will enforce deportation proceedings for somebody with one DUI (even though it is definitely a serious offense), but you never know. I was thinking of taking on the process of having this DUI expunged, and then applying. I understand that expunged convictions will not necessarily disqualify someone ,but will be considered in regards to the entire application. Since the expungement process takes 30+ days, with court hearings and such, I was contemplating on whether I should just go ahead and apply with the DUI (with a lawyer of course) and explain my circumstances surrounding the conviction and support my notion that I am in no way a threat to public safety anymore, and how I am serving my community so that they don't make the same mistake I did in the past. Just a thought.
