Will we qualify for New York State license with the EAD?
I'm confused as to the wording of the requirements when people say we need to show legal status in order to qualify for license; yet, DACA & EAD doesn't grant legal status. So how are you guys interpreting this and going bout it?

I mean I technically have 6 points already accumulated (without the EAD), but I don't have legal status yet. So....?

I remember going to DMV before and the lady told me I needed a valid I-94 (mine's expired) to get the license. So with the permit and SSN..that suffices as status for DMV is what we are saying..?

Download form MV441. It has all the instructions.

But yes you do qualify. All you need is the EAD and SSN card. That's it.

You prove legal presence, not legal status.

The Jan Brewers of West Oz want to make it about legal status, but it's always been about legal presence (regarding state ID/DL).

EAD, or even the I-797 of approved DACA in some states, proves that.

Yes, NYS has a 6 point system, and requirement for proof of date of birth (which only valid immigration documents satisfy).

Basically EAD is 3 points and proof of DOB/legal presence.
Social Security card is 2 points. *
Then you need 1 point: bank statements (1 pt) , credit/debit card (1 pt), college transcript with college ID (2 pts), high school ID with report card (2 pts).

* - Social security card is mandatory. Social Security Administration will issue you one once you have the EAD. You'll have to fill out the SS-5 form, check the box for "Legal Alien allowed to work", and bring the form together with the EAD to a social security office.

^^ WOW! Can someone hook me up with a license in NY? I live in NJ and we need provisitional license method and then 1 year unsupervised driving it's so much BS! Someone in New York let me use their address?? Or is that not required?
