Any older dreams who are also married and have kids?

So, my case is a bit different than most of you guys here.. I am married to a US citizen and we have a child together, the cutest little biracial thing I've ever seen!! Haha

Anyway, it seems like most of you are students, which is highly commendable in my book, I am going back to school next spring. I'm 25 years old.

Anybody else here have kids? Married?

Upon the acceptance of DACA, what are our chances of fully legalizing our status? I am contemplating the possibility of obtaining a green card and enlisting in the national guard to finish school and serve, if possible. If not, my plan B is to keep working and financing my education while supporting my family.

Thoughts?

You should have U.S. Citizen petition you since its faster and umm.. well you get more benefits than DACA. Pretty obvious your marriage is legit and not fraud so u should be good to go ;P

Didn't Obama make it less likely to have to leave the US to change your legal status if you're married to a USC regardless of coming here w/o inspection?

I would look into that. Congrats on getting DACA! And biracial babies are pretty cute

The requirement to leave the US is a general rule. It does not account for other factors. IE. caring for a child, taking care of an ailing family member, etc. You can get it waved. Just need to contact a lawyer on the proper route.

One of DACA's purposes is to allow time/resources for an individual to adjust their status. I assume it's to help applications be processed faster.

Well if you're a 245(i) beneficiary being married to a USC should be the way to go.

I have a friend who is also married to a USC, they don't have children but have been married for 7 years. She entered without inspection and does not want to leave the country to apply for the pardon or waiver and wait her visa abroad, so instead she's applied to DACA. Not sure, if that is also your case.

As for me, I have a 16 month-old son, he's a bright little boy I have two B.S. degrees in science that I finished in 2007 and 2008, and the job offers are just waiting for me to apply (thankfully). I have a petition thru my parents, but we all know it takes almost decades for that.... And as far as my son's daddy, he is also a dreamer, pretty smart engineer.

You could have also applied to get a green card at the end of this year. Provisional waivers should kick in by then. If so, you would not have to leave the US to wait for a visa or be subject to the 3/10 ban. You would be allowed to go to your cosular appt in your country on parole.

That's what I am waiting for. And Im not married yet. We are getting married in December. We have 1 son already and our second son will be born in November.

You should speak to an Immigration lawyer. They can tell you what your best option is.

Why the hell haven't you talked to a lawyer about this ?!? If you crossed over without inspection then I think you still need to go back, but they might wave the 10 year penalty. Or you may not even need to go back. Is $150 to see a lawyer not worth your future?

Same here... Already petitioned through wife but, will not submit adjustment of status until the new provisional waiver comes out. That way I don't have to leave the country... And by looks of it, DACA is way faster! My waiting time went from 5 months to 12 as soon as DACA came out. Which means they are using employees from dif. department to cover these apps.

I already have a lawyer who knows my case! He suggested that I apply for DACA to get my case going a little quicker, he opposed to the idea of my wife petitioning because it is not cheap, DACA is my best bet right now until I have an actual case with USCIS.
