There is no appeal process but you can apply again. Meaning if you're denied you can't appeal that specific application but you can start all over again and apply again. I read that some where on here

It says in the guidelines you cannot appeal a denial.

U guys made the same mistake I did when I answered first thing in the morning. He's put a scenario for u guys to consider:

821d accepted, employment authorization denied

As long as you didn't put anything outrageous on the employment authorization worksheet, you should be okay.

Outrageous being you make a million dollars/yr but only need $1,000/year

That's correct you cannot appeal that packet once its denied but they never said that you couldn't apply again.....

A review of something by an authority. And, you make a good point. I say, someone call and find out. I doubt it though.

TPS obtainment process, step 5.

"If you are found to be eligible upon initial review of your TPS application (prima facie) you will receive an EAD."

You can't appeal the denial of a deferred action application (TPS), but the obtainment of an EAD most likely is a standard procedure and has nothing to do with your TPS application once it's been accepted.

When you apply again, that is not an appeal. You are simply re-applying again. My attorney mentioned that you can reapply, but not appeal a previous decision.

I've said before that I believe USCIS intends to approve everyone for work authorization -- given that they're first approved for DACA, of course.

However, if for some reason the EAD were not approved, though you are granted deferred action, I would imagine that you can resubmit a work authorization application, stating that your economic situation has changed.

Now, being denied for DACA itself, that's another story. But the only people who have to worry about that are the ones with any sort of criminal record, or who don't meet one of the key requirements (age cap, entering before age16, etc).
