Should I have answered yes on the question to criminal conviction?

I wasn't sure if I should have marked yes. I got into a fight when I was 14 but I didn't think of marking yes because (1) it happened when I was a minor and (2) I didn't have to go to court. I honestly had forgotten, but I remembered that I did have my fingerprints taken at the police station.

That's a question for a lawyer. I think you should be fine because you were a minor.

i have the same issue!!! I also got into a fight (not really) and because i was 16 young and didn’t know what was going on I thought it would not be an issue... when i called the police station (even though it happened like 10yrs ago) I found out that I do have an arrest with a class A misdemeanor in my name.... i was arrested (not literally cuffed) when i walked into the police station because my neighbor claimed i hit her. i never did and was actually going in there to get a protection order against her because her crazy self tried to stab me. well she knew i was going to report her and tore herself up as if i had hit her. the police threw me in a room until 1/2 hr later when my parents picked me up. until now i thought my name was cleared but unfortunately it is not. i don’t remember going to court. ANYWAYS i got what they call the Certificate of Disposition... that states the outcome of the arrest. It was dismissed and sealed fortunately for me. Lawyer says I its not an issue when it comes to applying for DACA because the case was dismissed and sealed. even though it was sealed it still might show on a employment background check but IT WILL SHOW for sure on a FBI check. SO when i send my application i will mark YES for an arrest and MUST include the certificate of Disposition. ( i read it somewhere in the DACA app) You should talk to a lawyer, laws are different in every state. i live in NY. Maybe start by calling the police station at where it happened and then ask them if you they have a record under your name also to guide you as to where you can get the certificate of disposition( very important) if the incident shows up. good luck

I called USCIS and asked about about a misdemeanor that happened before i was 18. The rep told me to mark yes and to include paper work :/

damn that's some badass teen sure showed them not to mess with you. sock it them bruh...

okay jokes aside

it will appear once they do an FBI check on your ass so it would have been better to say yes then explain. even lawyers don't know if you will get denial or approval. but since you were a minor and you have been an outstanding person since then i suppose you will be fine.

I was arrested and fingerprinted when was in hs, I put no on that question. But I suspect I will get RFE when it shows up after biometrics

I had a similar situation. I was "arrested" but never actually got handcuffs put on me, never went to jail, never went to a judge and just was told to complete some community service and it would be done with. I was a minor. But after doing a whoooole lot of research, I came to the conclusion that I needed to answer yes to that question and provide the paperwork necessary. I had finger prints taken and it seems that this background check is very serious and absolutely everything will show up. I didn't want them thinking I'm hiding something.

Therefore I've been crapping myself since I sent the package. Hoping for the best! Good luck to you as well.

I'm not that worried. It was like 5 years ago. I didn't get handcuffed either, I was just forced to go to a 2-hour class. Other than that I have had a clean record over the years. I got into 2 fights in high school too, but they were never documented. Phew, saved my ass there.

Oh jesus now that i think about this i do remember getting into a fight in middle school with my best friend in school now we laugh about it lol well it was in the school cafeteria she got mad bc supposedly i said she had a big nose she came up to me and punch me in my face n left i was like oh hell no lol and as she was walking away i pulled her hair then she punched me we where pulling hair scratching ect they gave us tickets n i had to go to court i think i was 13 or 14 i went to court i did not get fingerprinted the judge just said dont do it again or u will do community service for the rest of your life i think she was just trying to scare me lol i dont think this school ticket will affect ? or am i wrong
