Yup, we mostly hear about the success stories. It will be the same in here, people don't like to talk about the sad stuff. Anyway, the decision is ultimately based on the officer. I remember the time when my mother was trying to obtain a non-immigrant visa to enter he country (B1), even though she had a decent salary as a Mexican government clerk, she had to make three requests in the span of several months before she could get one. Officers can be a total pain in the ass, but like you mentioned, attorneys, with good representation you can get far.

To be honest I don't know, because this is clearly stated in i-131's instructions. Hope it isn't discretionary and talk to an immigration attorney.

Advance parole is an extraordinary measure used sparingly to
bring an otherwise inadmissible alien to the United States for a
temporary period of time due to a compelling emergency.
Advance parole cannot be used to circumvent the normal visa
issuing procedures
and is not a means to bypass delays in visa
issuance.

Does anyone has been approved even thou the had a voluntary removal proceedings becuase my nd had one and was supposed to leave the country in the 2005 when was 14 years old but he never did. Because he was still a minor and his parents were here plus He had no family in his country.. got everything to qualify but that stupid letter of voluntary removal.. he didn't hire lawyer, we did it ourselves and he even got his Biometrics appt for Oct 04, and I'm afraid for him to get rejected because they may deport him back to his country and because we have a daughter
