I hope most people's RFEs are just asking for original documents or something else that is simple. Not including myself since I have weaker evidence than others who have received RFE.

According to the instructions on the form, if you're EWI and have never been in removal proceedings, you don't have to provide proof that you were in unlawful status as of June 15, 2012.

June bank statement and a DHL bill with me signing that I had received a package on the 12th I wonder If I'll get a RFE as well.
Dont stress ahead of time..Youll be fine.

So technically, he can be counted like an EWI if he couldn't provide proof that he was an overstayer.
i think if you entered with a visa and stay for more than 6 months(wich is the max time they give to stay legally) they should know he's overstay...

This is my curiosity with EWI and RFE. Those with RFE who have posted what they sent didnt have anything to prove your status and they all seem to be EWIs and they seem to have enough evidence for everything else.

The guidelines say you need to prove you entered without inspection or your status expired before June 15, 2012. In the instructions (where it says what documents can be used) it says this part doesn't apply for EWI.

So, basically you don't need to provide proof of your status.

Now, my question is... for those with RFEs, what did you put on your application on the I-821d for questions 13-15, and for questions 12-15 for the I-765? Does it all match and you answered EWI??

And if it's about gaps, what TYPE of documents did you send? Where they official documents or circumstantial evidence?

I'm just brainstorming here. I'm really curious about what people are missing to get an RFE.

People keep posting about getting RFEs but they don't know what the RFE is asking for >.<

We've heard about missing signatures... but what else?

I knew I should have kept that family video where we were documenting our journey across the border. Who would of thought that could have been useful later in my life? I simply destroyed it because I thought it would have a negative effect and have proof to deport me. Well that proof would have been the best proof to prove that I 'entered without inspection'

darn!

So theres a gap on my docs, from like march 08 when I graduated, to march 2010 when I started using my debit card, I know thtats a pretty big gap, but I was thinking (or may be just wishful thinking) is that theyre gonna be like, well his visa didnt expired until 2011 so if he ever left the country he woulve used it to come back and that would be on our records.

Please stop driving yourselfs crazy with speculation. Your apps are in the hands of USCIS so going bananas now is going to do nothing but give you an ulcer. Let him get his letter and we'll go from there.
