Hey Maortiz,

I know this is an old thread, but I stumbled upon it in a Google search. My wife is literally going through exactly the same situation as you! Our I-130 got approved back in March, but we do not want to proceed until the provisional waiver (hopefully) goes into effect. Have you proceeded with Deferred Action? My wife just got her Biometrics done today for the DA. We were pretty upset when we found out that even with DA and her having a SSN, she would still have to go to Juarez to process her visa. We are really hoping that the provisional waiver gets approved soon, because from what I understand the I-130 is only good for a year.

i did my biometrics done yesterday. i have called national visa center a couple of times to check on my case and they have never told that the i-130 was only good for a yr..the only way they can close your case is if they dont hear from you or if u dont submit any information in a yr. maybe you just got confuse

Hi there- I am an attorney, and I have handled lots of 601 waivers. I just wanted to add my 2 cents. Personally I would strongly recommend applying for the provisional waiver instead of hoping for AP through DACA. Yes, you will still have to go to CDJ, but only for two or three days. There is a lot of risk involved with the Advance Parole. I know that the waiver may seem like a daunting project, but it is the most sure way to proceed. Remember that although you can pay your visa fee DO NOT submit your paperwork to NVC because they will not allow you to apply for the provisional waiver if they have already assigned an appt in CDJ. Good luck!!

Wow im glad i this thread is here. I was also goin to adjust my status through marriage using the i-601 waiver. I had all my paper work ready but as soon as I heard about DACA I decided to hold it off. My opinion is that if you do exit the country through advanced parloe and you are denied and activate the 10/3 year ban to have your waiver package ready and give it to them right then and there and if the waiver gets approved then you're all set.
