Has any visa overstay recieved a RFE, it makes sense USCIS would be more picky with the 5-year continuosly residence evidence to those who are EWI than those who are visa overstay since there is no way they can know if they had left the country before, unlike a visa overstay who has to go through immigrations, also the fact that you live in a border state with your home country next door doesnt help either (CA service center) unlike an applicant whose home country is a continent away.... thats my 2 cents,

What you guys think?

I think...No wait I strongly feel that I need to receive my Biometrics letter pronto before I start going crazy. Also I really hope I don't get RFE but if it has to happen then let it be. I could have sent a lot more evidence to them and if they need it then I shall send as long as it means I'll get my EAD!

And yea your country might be right next door but that doesn't mean we always went back and forth when ever we felt like it. lol I sure as hell didn't.

Those are my 2 cents.

Well for most of us who are Overstay... We have not left the country because we couldn't go back if we did! LOL! So unless one didn't really submit good enough evidence that they were here... I don't think Visa Overstays would be highly scrutinized.

Hopefully that would be the case since it's easier for us to prove our identities compared to our EWI brahs.
