Yeah you guys need to get approved ASAP and then im assuming most of you have SSNs that say "valid for work only with INS authorization" needs to tell us what to do next haha.

I do think those with Final Orders should definitely be applying for this if it gives them ability to close their case jointly with ICE in front of a judge,which is usually approved.I do know of at least 2 individuals that ICE has jointly filed with the defense in order to have their cases closed[not under DACA but different circumstances] but they were eventually able to have their orders closed by a Judge.

What would be the benefit of having the case re-opened and closed? (after daca approval)

If you happen to travel outside the U.S. with an Advance Parole while your status is still in removal proceedings, you can be barred 10 years when you try to re-enter.

Doesn't the 10 year bar apply to everyone who's accrued more than 180days of unlawful presence anyway? So even if we don't have a final order, we're still subject to the 10 year bar.

The benefit of having someone's case closed is dependent on the individual.These are just general scenarios I've come across....

1.I have seen people mentioned they do this to Adjust through marriage if they were simply a visa overstay before and had an I-130 filed in addition to no criminal record after their Final order.

2.Individuals have also mentioned even using old Deportation orders[Pre-IRRIRA or before ~April 1997] in order to adjust as well through immediate relatives by an Immigration judge through Suspension of deportation.

These cases are unique,but the individuals have been able to overcome the issue of their Final Orders.For DACA applicants in general,it allows the individual to have a clean slate on their record.

I have spoken to my current attorney who has even heard about my previous one who got disbarred. He told me the best action in his opinion is to first get daca, then do a marraige based AOS where i can file a joint mOtion to reopen (i dont think he said joint with ice, i think it was joint with the government). This way i can file the i-130 not go back (overstay) and considering i have one of the best judges in the country (see previois page) the chances for closure and being approved are high.
