Hey everyone, I'm helping a friend fill out her DACA and she is trying to gather evidence. She has very limited info for the years 2009-2010. She doesn't have much in her name, as most of the bills are in her husbands name. So can she use bills in her Husband's name for evidence since she will be including her marriage certificate showing that she is married to him? Therefore, since they are a couple and live together, shouldn't USCIS assume that those bills also confirm her being present?

That doesn't prove she was here. She could be in El Salvador for all uscis cares. No, that won't work.

True that, That's what I was thinking. I'm telling her she needs to gather as much evidence as possible with things in her name. She's been out of school since 2004, dropped out of high school and just received her GED this year. She has been a stay at home mom pretty much since 2004, and most of the evidence she has is both of her children's medicaid cards, and WIC. So she has no work records whatsoever, everything is her children's info since she is the mother and takes them to their appointments, etc. I don't know what to tell her but her case isn't looking too good. Not enough evidence. She was just added to her Husbands bank account a couple of month's ago.

No point in sending a weak case because it is guaranteed she'll get RFE.

Couldnt' she get affidavits from the doctor's office saying that she has been bringing her kids there for how ever long she has been doing so along with dates of appointments. It seems like her best bet would be getting people to write affidavits for her. Also does she have any service documents that she signed like work orders done at the house that she can include. Maybe she's a frequent shopper at certain retail stores that have reward cards that she might have signed up for. Sometimes you can view your purchases like Sephora you can actually see your purchases online including dates. I would still include the household bills .

I would also recommend taking advantage of writing additional information. This can be done on page 6 part 7, but if you are already using that section for other things or will no have enough space then attach a separate sheet. I used a set up like this below. I also included the page, part, and item number you should be using. This is the part that asks if you have continuous stay for the 5 years and since she has but doesn't have much proof it is necessary that she explain further.
You will then explain that she is a stay at home mom and all bills are under the husbands name and finally that she can only provide affidavits regarding her children.

I-821D ADDITIONAL INFORMATION –CONTINUED

FULL NAME:

Page Number 3
Part Number 2
Item Number 1.b

I did this to explain that my original passport, ss, and i94 all had a wrong birth date for me . I am not approved or anything yet so i can't say it will work for you as I dont even know if it will work for me. It doesn't hurt to try .

Yeah, I'm going to tell her to get affidavits. She doesn't do much online shopping, as they just barely opened up a bank account. All these years they have made all their purchases in cash. Thank you for the idea of adding it on the additional information page. I'm going to tell her to get anything possible and to still include the bills in her husbands name anyway and explain it on the last page like you said. Her oldest is in 2nd grade so I'm going to include her kids school records. However, I'm going to tell her straight up to be prepared for an RFE anyway, since she never saved anything with her name or anything.

Tell her to give it the best shot that she can. Look every where. Think hard. Check email accounts. There might be something there. Getting an RFE isn't necessarily a bad thing. The RFE will tell you where you fall short.
I know its hard trying to document an undocumented life but this is an opportunity that shouldn't be passed up.
