Her mom screwed up big time but the girl still qualifies for DACA and can still come back and get it.
Here's the rule: If u left the country after August 15 u don't qualify. In Esmeralda's case, she was present in the US on June 15 and left (june 27) before august 15 so she actually does qualify. Her lawyer just has to argue her case well. Good luck to this poor girl. As for the mom, no chance of coming back!

You have to be present in the country to apply. So she'll have to get smuggled back into the US first. It's most definitely a complicated case. Stupid stupid mother. Poor girl.

The media attention is what probably ended up screwing her over. Had everything been kept on the down low, she might have been able to secretly go back into the US and still qualify for DACA. After all, USCIS has allowed people to have had innocent and quick departures.

Now, if she was smuggled back into the US, DHS will be aware of it because of all of the attention she has gotten.

Agreed!

But I think her mother might think it will have the opposite affect. That perhaps she will be allowed to return because of the attention.

story of my life. My mother and I came on a passport. Before they expired she and [I returned to rernew them and were subsequently denied and had our passports stripped. We had to recross without inspection thus my EWI status.
