I know some of you applied after me, and already have gotten it, so I called DMV. They said that my legal presence is still being verified and asked me to call another number to get the whole story. Called that and got a hold of a lady named Deborah, who at first didn't know what Deferred Action was. After me explaining my case, she asked me to fax over my I-94, EAD, and Social Security Card to her, for her to process all of that information. Now I got wary because none of the people who got the DL had to do this, so I asked her why me? She was sorta rude, but she said that it's because my application was in a pool with other applications, and that I just have to wait, whereas if I were to send in my documents to her, it could speed up my process.

Question is: I am already 4 weeks into it, and DMV said that it may take UP TO 6 weeks. So, should I just wait, or just fax everything to Deborah? And secondly, if I do fax in everything, what if I get the dreaded 2 year DL? I know everyone's been getting the 5 year one, but IF for some reason I get the 2 year one, can I talk to someone about this and have it changed?

If it were me in that position, I would call USCIS first. Let them know that the DMV is having a problem verifying your status, see what they say. Also, I would go to a different DMV, or try calling again. Just get a second opinion. Cause that sounds strange.

And honestly, I think if anyone gets a two year license, which I know a few have, it should be something you could fight. No where does it say it needs to be two years for us. That is bot the law. And I personally don't think it should be up to a dmv employee to decide.

Thanks, that's what I was thinking too. If Romney gets elected, we won't be able to renew this, and at that point, having a 5 year DL will be so much more beneficial than a 2 year one.

Wait it out 3 more weeks. So, if you haven't received anything after 7 weeks, one week more than what the DMV said to wait a maximum of, then just go ahead and fax your information over to Deborah. Maybe your patience will be rewarded with a 5 year expiration date and no mistakes on your card.

I, for example, received my card today with a five year expiration date on it, however, there were some errors with my name and so I'll have to forfeit my card while they issue me a new one that is mistake free. That means I'll have to wait for my card all over again. :/

I think that you won't have to worry about losing your 5 years, since you already got it the first time. They'll probably just fix your name and keep everything the same.

As for me, if i don't get the 5 year one, i definitely intend on fighting.

Be careful of the DMV, dude. Just saying. They can do a lot of evil stuff to your license....like....idk...make it disappear...and you'll be crying for those 2 years.

But, it's my LEGAL right to get the DL for 2 years, no? The only reason I want to fight is because it's not fair for me to get the 2 year deal when I am following the same system as the people getting 5 years. It seems like I am being petty and whiny, but I have been waiting to get a DL ever since I turned 16. And, I am going to make sure that I get the right damn license, the one that everyone else does, and not some "special" one

In CA there are no special licenses. You either have one or you don't. It isn't a "temporary license" or anything like that. And, between you and I, in CA as long as you have a social, you can renew it when it expires. But shhhhh don't tell anybody, ok? You have to prove legal presence to GET a license. But after you get it, all you do is renew. You have a SSN, you're set dude. I have family that have ZERO legal presence here, but since they obtained a SSN back in the day when it was easier, they just renew. There is a dreamer with an uncle that has a deportation order but was able to renew his license bc he has a SSN.

Well and it's not like you're going to sue them or something. It's all a matter of going in and talking to someone. Letting them know that the law that governor brown signed did not specify to a different time limit for deferred action. They have NO reason to make it a two year license, other than just the DMV employee not being properly informed.

That's really good information to know. Maybe it's not worth fighting it then lol. Thanks for the post!

Seriously? Well shit then, that would be cool. But, won't you actually have to go in to renew and show them your up to date legal presence? My dad has a DL that he got with his social, and he renewed it too. But, they said in 2014 when he has to renew it again, that he has to show papers, because they changed the rules. Know anything about it?
