No some people are confused. The 75 day service request you can do. The 90 day request for an interim ead if your 1765 is not approved in 90 days you are not eligible for until DACA is approved. There is a big difference.

75 day thing: I have posted it multiple times."So, i think people are confusing the 90 day thing with this 75 day thing. Check the status of your request on Case Status Online. THIS IS THE 90DAY REQUEST.
The 90-day period for reviewing Form I-765 filed together with Form I-821D begins if and when USCIS decides to defer action in your case.

THE 90 DAY PERIOD FOR REVIEWING AFFECTS THE INTERIM EAD PROCESS
Go to pg 1 of Instructions for I-765 and read on the second column titled INTERIM EAD= "An EAD issued to an eligible applicant when USCIS has failed to adjudicate an application within 90 days of a properly filed EAD applications, or within 30 days of a properly filed initial EAD application based on an asylum application filed on or after January 4, 1995. The interim EAD will be granted for a period not to exceed 240 days and is subject to the condition noted on the document.The interim EAD provisions apply to individuals filing Form I-765 based on Consideration of Deferred Action for Childhood Arrivals only after a determination on deferred action is reached.

30 Days=For asylum applications only
" or within 30 days of a properly field initial EAD application based on an asylum application filed on or after January 4, 1995.
90 days= For all other non asylum applications
"An EAD issued to an eligible applicant when USCIS has failed to adjudicate an application within 90 days of a properly filed EAD applications"
90 Days for DACA applicants=Only after Deferred action has been granted.
The interim EAD provisions apply to individuals filing Form I-765 based on Consideration of Deferred Action for Childhood Arrivals only after a determination on deferred action is reached.

So, if your DACA is granted and you haven't received an EAD within 90days you get an interim EAD that will be valid for 240 days. BUT DACA HAS TO BE GRANTED FIRST. So that is what the 90 day period refers to. I think the USCIS people are badly trained. They are giving people different answers. Some people are receiving the it takes 4-6 months speech and others get their ears filled with honey.

That's good to know!! I sent mine today (day 90). The rep told me to call back at the end of next week if I'm still on initial review and they will issue an interim EAD. We'll see how it goes.

It also depends who you talk to. Some people tell you to wait after 90 days and just read you the initial review bs. The lady she talked to was very helpful. She told her that the service request was just to let them know that your 90 timeframe is near. With all the people getting approved that sent there app 1 month later after her, I don't blame her for trying something. I got approved 2 weeks ago and we sent them in the same day on Aug 23, and did our bios 1 day apart no walk ins. She was the only one not approved in a group of 20 different WAC numbers.

Both my daca and EAD got approved on the same day...I would suggest not bothering them until the 90th day after they received ur app has come...so far no one has gone past their 90th day without approval

Congratz again. And im on day 90 today. So I hope I'm not the first to go past day 90 w/o approval. Lol.
