but you're right as far as the previous removal order no one at this time knows how they process it. To me it makes no sense for them to give us any immigration relief with out taking care of the removal order. Now if you read this entire thread this is something we have discussed about and I know for a fact there have been removal orders in the past where the person got married or did something else to get green card however their court case from another immigration service was never closed. They ended up getting deported by a judge even though they had green card. It's a screwed up system and it also has a lot to do with luck.

BTW yes I send them a copy of my last court date as evidence and my A number from my old case matches A number from deferred action application.

The big question in everyone's mind is only an immigration judge is able to cancel removal order and the reasoning for long wait could be because they're waiting to save all removal order and sign it off through a judge all at once to prevent backlog. If this is the case we will all be waiting for a long time. Now I know there's one guy with removal order from 2000 who was approved and I can't comment on why that happened. Maybe his history was not on their new system? Maybe he didn't put his old A number? Processing error with USCIS? 10 year myth being true? Who knows....

well feel free to comment / provide info you may know

overall approval rate is only at 18% (official USCIS numbers) so i'm not terribly worried but you should all expect a longer time frame for approvals if you have deportation order
I don't have deportation order yet, I just have an individual hearing date in two months and I can't find any info about what to do with it after I get approved or it still haven't gotten approved yet by the hearing date.
My lawyer says I can request terminate proceeding after getting approved, but I can't find any info anywhere to confirm.
Regarding the case of getting green card and then deported I think they forgot to ask the court to terminate their case after getting green card. I can find info online about terminating case after marriage with citizen but I can't find anything about deferred action while still in proceedings.

well this is a new process and no one has done it before for it to be online

you can defer your hearing (unless you have an anal judge) (I was able to defer my master hearing with very little trouble ) this should be fairly easy but your lawyer might want to end it instead of extending it. Look into "administrative closure" This will remove you from further hearings but you will eventually need to go back and close your case.

Now if you are approved for deferred action by your hearing date then termination would be your best bet. The only downside to this is the court might not terminate it because according to USCIS deferred action does not give you any legal status so in the eyes of the court you are still illegal. You definitely will not get deported the only question is if you should go for termination or administrative closure...

I'd like to get more feedback than this.. I'm at 85 days and im also at Initial Review still. Last time I read, only ONE person was approved that had a final order of deportation. Anyone personally approved or know someone who was that fits this scenario.
