For those of you who have only been approved for DACA... I just want to know the step I need to take if don't get any response from my EAD since I am already approching the 75 days since my DACA was approved.

An Interim EAD is issued when USCIS has failed to adjudicate the I-765 application within 90 days.

What you can try doing is calling the Customer Service Hotline on your 75th day and asking them if they can notify the Service Center that the 90 day processing time is ending.

If you don't get approved within the 90 days, then you can call them back and see if you can be issued and Interim EAD.

You still have a long way to go.

Actually the 90 day period in our case begins when I-821D is approved, so if you get your I-821D approved and then nothing happens for 90 days you can file for an interim EAD.

So yeah in your case 15 more days and you can get an interim EAD. Weird though, usually both are approved at the same time.

Yeah, he/she was approved for the I-821D on 10/02. I-765 is still pending.

Still a long way to go.

Look what I found regarding infopass and interim EAD

Alright, my situation-91 days and still counting. Just returned from my first infopass appointment. Though irrelevant, just to give a fell, a quick update on how the things work at the infopass appointment-- You go there, airport like security check, you may carry mobile, but you will have to switch it off. After security check, guard at the entrance will check your infopass appointment letter, and appropriate Identification, then he would hand out a feedback form which you are supposed to fill after interacting with the immigration officer. (not sure how effective those are, but I did fill out). Then you will be asked to stand in a line, just like visa stamping line, the officer at the window does the first level check and assigns the ticket number for an other officer to do a through check. Then you will have to wait for your turn to talk to Immigration Officer (IO). If you are lucky enough, unlike me, you will get a nice IO.

Well, my experience, disheartening. The whole conversation goes as follows:

IO: Good Morning, what brings you here.
ME: GM, blah blah.. My I-765 is pending for more than 90 days and there has been no response.

IO: Let me check your documentation (reviewed my I-765 application, Bio-metrics completion form etc).
IO: Due to DACA( I think she meant, deffered action for childhood arrivals) we have about 1 million EAD applications pending, and the processing is going a bit slower then normal. And I can't see any update on your case.

Me: (My heart immediately drowned 30 feet in Hudson river and thought to myself, what crap 1 million, I immediately wondered what the folks at port of entry doing- laying eggs ? ) After recovering from that, I said, very sad to know that but can you pls advise what is the situation with my case, did someone review the case ?

IO: It's under processing.
Me: (amazing news, yeyyy... as if I don't know) I understand its under processing, but at what stage and when can I expect to get the EAD.

IO: We can't say that, the file is currently at Vermont Service Centre ( as if I don't know )
Me: I am aware of that, so can you please raise a request for expediting and also for an Interim EAD ?

IO: I can't raise a request for expedite as its not 90 days. And more importantly your expedite request was declined within the last 30 days.
Me: It is more than 90 days.

IO: you applied on August 16, today being Nov 15 its 89 days and 90 days will be tomorrow.
Me: ( I thought to myself what pathetic situation, and what should I tell this poor soul) Having recovered from that thought, I told her, August and October months have 31 days, so technically speaking its 91 days today.

IO: Gave the dumbest smile ever
Me: Smiled back in disbelief.

IO: Next thing, I can't raise a request for Interim EAD, they are not issued anymore.
Me: (I thought what crap) I pulled out I-765 Instruction form and showed her the option of Interim EAD.

IO: Once again, smile, this time dumbest x 10 times smile, and she said I will have to talk to my supervisor. Walked away with I-765 Instruction copy
Me: waiting and thinking what crap conversation I am having, and I wished she reported to at least someone knowledgeable and sensible

IO: Ok Sir, I will raise a request for Interim EAD, and the vermont service centre will get back to you within 2 weeks.
Me: 2 Weeks is extremely late, I have waited normal processing time, and I would expect to receive an update sooner than that

IO: Sorry sir, that is what I can do.
Me: Can I please talk to your supervisor and explain the urgency of my case.

IO: Sorry Sir, You are not allowed.
Me: Ok so there has to be some better alternative. Can you please do anything about that.

IO: Ok Sir, I will try
Me: As I wait for her to speak, she Looks and scrolls on the system

IO: Ok Sir, You are going to hear from them in the next 5 days. I will give you the service request number.
Me: IO handed out the printed form, with the SR number and manually wrote on that expected revert is within 5 days. I reviewed it

IO: Is there anything else, I can do for you.
Me: hmm. I was like, thanks for coming this far. Thanked god and walked out. Before that filled the feedback form, you can imagine what I would have filled after the dumbest conversation

But personally, I fell, the folks who are making plans expecting to receive EAD sonner, please brace for impact. Fell sorry, but seems like it's going to take longer than usual due to DACA. Please consider yourselves lucky, if you receive EAD soon.

All the best everyone, I wish everyone has EAD approval at the earliest.

The 90 days don't start until your I-821D is approved by the way. Not from when the Service Center receives your application.

Dude, I know that.. that's why i said i am approching 75 days (Dec.17) and the 90 days i guess i'll have to wait till Jan. 2, 2013 since it lands on Dec.31

Is 75 days a kind of milestone, I don't see why so set on 75 days. Sorry for my ignorance but hadn't heard of such a gap between DACA approval and a potential EAD approval, good luck and hopefully this will be resolved soon.
