Help, with applying with FAFSA. I currently have U1 Visa-Victim of Crime. However, neither the school nor Dept of Ed. have any guidelines on whether or not to accept the U Visa for Financial Aid. I have contacted USCIS about the issue and they told me it was up to the institution...

What do you advise me to do next?

I don't think USCIS would know the answer to the question because I don't think they have any power over FAFSA I think it would be up to the Department of Education.

The National Immigration Law Center (NILC), the Legal Aid Foundation of Los Angeles (LAFLA), and Legal Momentum are pleased to announce that the U.S. Department of Education (DOE) has determined correctly that "qualified" battered immigrant students are eligible for federal financial aid under the same rules that apply to citizens and other eligible immigrants. DOE is developing procedures for providing aid to these domestic violence survivors while protecting their confidentiality.

Yes I have done all of the above suggestions to no avail. I think it's time to call a Senator.

It sounds like there is a procedure in place depending on the type of U-Visa you hold. If your UVisa is designated as "victim of human trafficking" then you are eligible.

Ianus is really familiar with the UVisa. I had a friend who had a UVisa but this was before 2007 and I don't think she received financial aid. Not sure if it was because she was still in the process of being accepted or since she was a daughter of the UVisa victim.
