You can argue about it and say you were below 18 and had no choice on it. If you dont have any criminal records, I would take my shot at it. If they say No than no but what if they say yes?

I think you should just apply since you were here before 16 and left for less than a year, just make sure you have proof of being in the US before 16

Dude XAV just file it i am aslo in the same boat, I did file with 2 employment records because I did not had any other proof than that of age 16 but i am still looking for something more. But anyway you can just wait till dec 27 2012 because this new law Just passed which you could file under yours wif'e's status ( I-130) and you would be permanent resident within couple months... just chill and you have better option than this DACA.

yes that's a record but not a criminal record . he should go a police stations and fond out how he can get a background check.

I think you could apply but it's going to be a very tough case. You left the country and there's no record of your return cause it was by feet. I can't really say if you should apply so continue talking to lawyers or simply email or call uscis and ask them how the rules apply in your case.

You are right, and yes I didn't had any choice by then., I could prob give it a shot.
