Family Unity Waiver for immediate relatives

So, I had a question about this. Is my understanding of this correct in that this waiver would allow an immediate relative (child, spouse, or parent) to adjust their status without having to serve the 10 year ban since you can apply for the hardship waiver while you are inside the U.S then leave to pick up your visa if you are approved?

My brother who is a U.S. citizen will turn 21 this March just as this waiver is being implemented. Would my mother be able to apply through my brother with I-130 to get a visa so she would be able to apply for permanent residency?

I think she should apply for him now, and once he gets approved, before march, he should then apply for the waiver. But speak to an immigration attorney like in Monday because it would be a shame if he missed it just by a couple of days.

Wait, my brother is already a USC. It is my mom that is adjusting her status.

Lol ernier read it wrong and yes she should be able to adjust her status through your brother. My brother is 21 and would do the same with me mom.

Once ur brother is 21 he can petition ur mom, my siblings are all USC but my third oldest sis petitioned my mom n she first got her work permit n later within the month her residency arrived....it took a year cuz we didnt have the money...

If ur mom entered without inspection the new law will apply to her, this would also apply for my dad who hasnt filed yet

My mom came as a visitor so its different just givin u details of the time she got her work permit n residency

I had a different question .. I got approved and have EAD, SSN ETC..my wife n I are married and have children, does she need petition me thru I130 form so I. can later apply for waiver
