won't hire because of EAD

I need some legal advice. I was offered an internship and now they just withdrew my offer just now because i have an EAD. They said they won't hire people unless they're citizens or permanent residents. I thought they weren't allowed to discriminate because of your legal status.

Well I think the basis for which you qualify for the Internship would have to be set in stone.Did they mention the aforementioned status as a pre-requisite?

they didn't, i signed the offer letter and everything. they did a drug test passed and a background check and didn't even bother to contact me until i contacted them about starting. the dumb hr lady said they don't hire people with EADs because they don't sponsor. I fucking quit my job because i was to start this week.

Ah,that's the problem.A lot of individuals in HR are not usually well trained on immigration status so if I were you I would trying contacting someone else in HR and explain that you don't require 'sponsorship' in order to meet their current guidelines or ask for her supervisor.

What type of job was this? If you are working wit stuff that requires government clearance such as federal contracts they could require USC or LPR status. But, if is obvious they are just discriminating contact a labor lawyer to look into it. You don't need sponsorship. Did you take a copy of http://www.uscis.gov/USCIS/Humanitar...-employers.pdf

It was an accounting internship for a regional energy company. I just got off of the phone with their equal employment opportunity officer and explained the situation to him. He told me they do hire people with EADs but that it's more complicated, but that makes no sense because there really isn't a difference. You're either allowed to work or not. He said he was going to talk to the lady in HR and look into it but he also kind of backed her up by claiming that the company likes to hire "long term employees" and that people with EADs don't fit that criteria. No where in the application process was i informed of this. ugh
