I arrived undocumented in the united states in 1997when I was 14 years old, (born May 20 1981).

I turned 31anos on May 20 1012, 3 weeks before the defered action announcement.

I quailify for defered action on everything EXCEPT I have turned 31.

I have been in the US for 16 full years.

What can I do? Can I ask for a varience or exception?

Thank you in advance for an answer.

I cant seem to find anyone who can tell me.

I feel you man. I really don't know what would be the correct route. I wonder, as seeing DACA is being done at a case by case basis, would they give leniency towards a case like yours.

Also what happens to a denial, would someone who has been denied without a criminal history be subjected to a appearance?

My opinion would be to hold out for CIR. The risks are too great currently.
Also have you spoke to a lawyer?

I think the intent of the Congress is to challenge the issue of immigration and perhaps that might be your best way as yonah mentioned.If you don't meet the base requirements I don't think it would be a good idea to apply or if you do speak to a lawyer.

You have to meet each requirement to qualify for DACA. What they mean by case by case is that each application depends on the evidence that you submit. Everyone will submit different evidence, so each case is case by case.

Unfortunately, you do not qualify, so the next best thing would be to wait and see what happens in the following months with the Immigration Reform.

Sorry, but you don't qualify. You can consult a lawyer if you want.

They had to draw the line somewhere, and they drew the line at 30. Now, there will be people that were born a day late, but the line is the line. Hope CIR passes for you guys.
