if there is no I9, you will be fine but its not something you should do. Both my parents were able to get jobs with their own SSN stamped valid for work only with EAD (but EADs are expired). If your job requests an i9 you are ineligible because along with an SSN that is stamped Valid for work only (stop saying not valid for work without authorization, thats not what the stamp says. It either says Not Valid for work <<OR>> Valid for work only with INS/DHS authorization) you need to present the EAD.

By LAW after the Immigration Reform and Control Act (IRCA), Pub.L. 99–603, 100 Stat. 3359, was enacted all employees and employers need to have an i-9 on file reason being the I-9 was introduced ensure that all employees presented documentary proof of their legal eligibility to accept employment in the United States.

I am not able to work legally. But I am able to file taxes, as I have done before, with this #. I told the manager I don't have green card but "I have SS # that we can file taxes with"



Ah ok. I've had EAD before and I've filed taxes with this SS#. But, the EAD has been long expired and because I stayed in the same workplace, I kept filing taxes with the same SS #.

Basically, when I got hired at the last place, I had legit EAD, so no problem there.
I kept working there, EAD expired, no update was requested, and I kept filing taxes with the same SS#

Now, no more EAD and new job. I'm hoping the employer wouldn't bother with I-9.
My former employers never asked me for a new EAD either when my EAD expired, though I have always able to renew my EAD. Were you OPT when you had your EAD?

I would say do not fill out I9 with false info, especially if you are waiting for your DACAments, just put off filling the I9 I'd you can until getting your new EAD.
