Maybe they couldn't get it bc they still have current visa or I-94. Some tourist visas from mexico lasts for ten years while the I-94 lasts for only half a year. Still need to know if there I-94 is current because that's what it makes them to be still in legal status because visa only allow you to travel up to 25 miles from the border.

He says their visas are current but apparently his son's visa was lost...then he said he hopes the request for review of his case isn't negatively affected by it. Then he says the immigration lawyer said they apparently entered without inspection (EWI). Not really sure what's going on there, why would his daughter need to EWI with a valid visa?
@butterfly: I'm almost positive the "Rejected" cases on the USCIS statistics are applications that are sent back to people for being incomplete (I.E., blank fields, wrong fees, etc).

probably they entered EWI and before reaching their 18th B-days they went back to get a visa. I think that just because their visa are still valid they don't qualify for the program.

no i meant the thread where they talked a bout why his/her sons were denied, she/he does not state why in that forum. Only says they were on a Visa when they came
