Thank you for the inquiry submitted to the Office of Citizenship and Immigration Services Ombudsman (Ombudsman’s Office).

In response to our inquiry, USCIS has informed us that your case is actively being adjudicated.

Unfortunately, USCIS will require more time to complete its review. At this time we are unable to provide a specific time of when a resolution may occur. We understand that this requires patience from individuals like yourself, but we would like to assure you that we will continue to monitor USCIS’s progress and we will inquire about your case again after 60 days. Please let our office know if you hear from USCIS during this time period.

Please note that the Ombudsman’s Office cannot compel USCIS to make a decision on a case, nor can it require USCIS to change a decision that it has made. Additionally, the Ombudsman’s Office is unable to help if you are seeking legal advice or assistance with an issue that does not involve USCIS. Please visit our website www.dhs.gov/cisombudsman for more information about our office.

Thank you for giving the Ombudsman’s Office the opportunity to assist you.

Sincerely,
Arie

Yes, I did ask. According to the lawyer, misdemeanors concerning traffic violations (especially driving without a licence) should not cause denial of deferred action. He said he had handled cases where the applicant had traffic misdemeanors and approved. It's just that those of us with prior records must undergo more background checks and criminal record checks since we've already disclosed having a record.

I am close to reaching my 6-month mark, so I was getting frustrated seeing so many people that applied after me get approved. I decided to speak with an immigration lawyer. I told him my statistics and that I had at least three misdemeanors all related to traffic violations (ie. driving without a license). He said that the reason my case was taking longer was because it was being processed along with all the other applications which have records attached to them. It wasn't easy to hear, but now at least I know that is one of the factors contributing to the delay of a response.

Perhaps this information is of use to some of you out there.
Best of luck and, more importantly, perseverance to us all.
This is from the ucis site ''A minor traffic offense will not be considered a misdemeanor for purposes of this process, but it is important to emphasize that driving under the influence is a significant misdemeanor regardless of the sentence imposed. You can find detailed information in the National Security and Public Safety section of the Frequent Asked Questions.''
You'll be fine. I dont know how old you are but it seems the older you are, the longer its taking. Since its a bigger gap from 16 till now, there's more things too look at... more records and paper trail of things. GOOD LUCK!
