Similar boat here. I was told to ask here instead.

I’m trying to find it in the bill but I can’t find it if anything like this exists.

I qualify for the Dream Act (too old for DACA at 33) under this bill so I will apply when it is approved, however, I married a US Citizen in 2004 and we have two daughters. I’m EWI so I can’t adjust without leaving the country. I understand that the time required to be away from families has been shortened by form I-601A, but it would still require me to leave and the form says that I am ineligible because I already had an interview scheduled to appear (in which I didn’t show up because of the 10 year ban). It also doesn't guarantee that I'd be let back in?? I don't know.

My case is complicated and I'll be seeking legal advice (again) once this is all passed. I have a valid SS given to me when I was a child with my name on it. I use it to work while claiming citizenship on I-9. The legal advice I got two years ago was that I still couldn't do anything because of the EWI.

So with this new proposed bill, is there a way to adjust my status to Permanent Resident without having to leave at all? Or just go the DA route? I have my BA.

Tonyhasadream, I think if this bill passes,they won't make anyone go to their home country... best of luck to you & everyone else!

dreamofgold, I entered without inspection so I would be banned for 3/10 years if I adjusted right now, unless I got approved for the prov. waiver, but we dont want to travel to Juarez...

That part basically means that you are only ineligible for the RPI if you have done bad stuff, felony and such since receiving DACA.

(c) ELIGIBILITY.—Beginning on October 1, 2014, the
5 following aliens shall be eligible for merit-based immigrant
6 visas under this section:
7 (1) EMPLOYMENT-BASED IMMIGRANTS.—An
8 alien who is the beneficiary of a petition filed before
9 the date of the enactment of this Act to accord sta-
10 tus under section 203(b) of the Immigration and
11 Nationality Act, if the visa has not been issued with-
12 in 5 years after the date on which such petition was
13 filed.
14 (2) FAMILY-BASED IMMIGRANTS.—Subject to
15 subsection (d), an alien who is the beneficiary of a
16 petition filed to accord status under section 203(a)
17 of the Immigration and Nationality Act—
18 (A) prior to the date of the enactment of
19 this Act, if the visa was not issued within 5
20 years after the date on which such petition was
21 filed; or
22 (B) after such date of enactment, to ac-
23 cord status under paragraph (3) or ((4) of sec-
24 tion 203(a) of the Immigration and Nationality
25 Act (8 U.S.C. 1153 (a)), as in effect the day 271
EAS13500 S.L.C.

Ok so my understanding .. is that if you have a petition and you have been waiting for more than 5 years you can apply to adjust from october 1st 2014... i hope thats what it means

So I'd be better off going the DA route to get a valid DL (mine has since expired that I got before FL was giving them out with a Notice of Action letter and then they stopped) and being able to travel outside of the country.
