currently in school,

have graduated or obtained a certificate of completion from high school,

have obtained a general education development (GED) certificate, or

are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States

If you meet any of those, you can apply.

I have a GED and was approved for DACA, no problem.

If I'm understanding you correctly, you are in HS 6 weeks away from graduation but you are thinking about dropping out and getting a GED so you can apply for DACA quicker? If so I wouldn't recommend that, they have scheduled GED tests every couple of months (at least in TX where I took it was like that) and what if you don't pass right away (which you probably will cause it's easy peasy)? Also, after you pass it takes awhile for them to mail your diploma (i can't remember exactly, it's been awhile). If I were you I would just wait to finish the semester and graduate with your class. Good luck!

Oops, sorry I re-read your post and realize I had misunderstood.

What are the requirements for residency tuition in NY? Most states require proof that you have lived in it for at least a year (you usually show state tax returns) although when i lived in TX I went to CC and only showed GED and TX license so you might get away with it. Good luck!

from what i've read the requirements for residency tuition in NY are have gone to HS over there or have obtained a GED in NY the requirements to take a GED in the state of NY are to have lived in the state at least a year like you said but regardless the college linked up with the law offers a GED program through the college. Also in regards to the living in the state a year before i would have to do that regardless of what state im in considering the fact that florida doesnt offer in-state tuition at all its either wait a year to being college or pay out of state tuition crossing my fingers a law is passed. i also read that theres one college thats part of the NY law that provides full scholarships to undocumented students its an honors college and of course the scholarship applies to intelligent individuals and i do not know if this is also offered to students who obtained there GED and if it then becomes a matter of how well i preform on the exam but this is something im calling the college about and hopefully they know the answers.

Don't drop out. Graduate and then if you need to, get a GED in another state.

I already have a High School diploma but I have family living in NYC, so I could easily claim in-state there, except for the part where I need to have graduated from school in NY. I graduated in a state that doesn't offer in-state for DACA recipients which prevents me from going to college at the moment.

If C.I.R doesn't pass soon I'll probably just take the GED test so I can get in-state tuition. They will gladly take your money so you can take a test that you don't really need. Just tell them you dropped out in 12th grade.

Another thing, I can't tell if this really works. But because you can keep taking the GED test in order to gain better scores. There's a possibility that you could take that GED in NY get a NY diploma and then say take your math test in California and if you do better they will update your scores and issue a new diploma. So if you were to take it in California you'd get a California diploma.

GED Testing Service develops the GED® test and works with each state to offer the test. The credential is issued based upon rules of each individual state—most states have slightly different rules and regulations.
Because of the state-by-state differences, GED Testing Service doesn’t issue diplomas. That’s why we encourage you to work closely with your state to get an answer.
You can call New York’s state office at (518) 474-5906.
