So I have a situation that I learned of today and I hope some of you can give me advice. This is not my situation but a relative of mine.

My cousin married her boyfriend, she was an overstay, the boyfriend a US Citizen. They were a legit couple and the boyfriend knew her situation, loved her and helped her get papers.

Now my cousin has a Conditional Green Card, and has about 7 months left until she can file for a Permanent Resident, but her husband wants out of the relationship.

If they file for Divorce, she has to file it. The lawyer said that they would need to prove that it wasn't fraud. Which is wasn't. The lawyer said it would be very hard to prove it wasn't fraud. Is this true? I mean how hard can it be? But now my cousin is caught between a rock and a hard
place.

What does she do now?

Any help would be appreciated.

If it was really a legit marriage, a good lawyer can find a way. We're not lawyers. It doesn't hurt to find a second lawyer as well.

Very good question because I've also wondered this.. Why doesn't he just stick it out for 7 more months?

......I think the lawyer is talking about a 'Good faith' waiver under the the I-751.Your cousin will keep her current status but might still be able to remove conditions provided she can prove a 'bona fide' marriage during the time they lived together through evidence and paperwork. It shouldn't really matter at this point if they get divorced as it would still be possible to remove conditions.
