I clicked on this thread expecting to read of how you committed theft in the PAST before applying for DACA, maybe while you were younger, but I wouldn't have imagined that you committed theft AFTER being approved for DACA!

That's just plain stupid.

It disproves that you have good moral character, which has always been a requirement when receiving immigration benefits. It would all depend on your criminal history as to what happens from here on out. If you have a history a judge and DA will probably not be so lenient on on you and you subject yourself to the discretion of whoever handles your case.

Without trying to judge you, acts like these don't "simply happen". So, if you felt comfortable taking the bike, it means you've been comfortable with it before. Whether you have a criminal record or not and how it will effect you in the future, Idk. It'll all depend on how many times you've been caught before. I'm guessing more than once.

You had a new lease on life, kid. And this is how you chose to live it. You won't find any sympathy in these forums. My suggestion is go speak to a lawyer and get it knocked down to the lowest possible charge or dismissed altogether. Good luck.

It sounds like a YOLO CIMT[Crime Involving Moral Turpitude],What the state charge is doesn't really matter but how US immigration law interprets the offense is what really matters.Check 9 FAM 40.21(a) N2.3-1 B13 & C 4-5

Okay, okay. There's ton of back fire here and that's understandable and reasonable. In a perfect clear state of mind, you could be like well, LOOK how you ruined yourself, idiot, scum. Etc., Etc.

I was stupid from the before the act. I don't know how else to put this, but like literally, I was in a stupid, insane, state of mind before stealing the bike.
Now, I don't usually put myself at risk and deciding oh yea, let's just take a bike. Or, oh yea, I have no remorse. Of course, I wouldn't like it if something stole from me. Or a bike for that matter, you know why? Because it actually happened to me!

Before this had happened, I was at the library a few weeks ago. And let me say, biking is the only way I get around so once my bike had been stolen from me at the library. I had to travel MILES to get everywhere.

Continuously, and intravenously, from my job as a sign shaker at the insurance company that I'm currently under employment for, to the library where I consistently, day in and day out, submitting applications, including the gym. I had to walk.

And like I said, CONSISTENTLY, I had to see bikes around, reminiscing the fact that I had lost my back and facing the fact that I probably won't have another one anytime soon, because of a drawback in my current financial status.

No, I don't expect pity whatsoever.

But consistently, the bikes became appearing to me, unchained, and the idea soon formed and breed itself, into a kind of lustful resentment. Because I knew I didn't have the guts to steal a bike, I wasn't a thief. My biological father had been a thief, and I had vowed to myself never to become one like him.

Anyway, on the night before the event. I was walking over to 7 eleven. When I came out, two other young males at about the same age I am, hit me up, so to speak, taunting and boasting up their gangsigns. Granted, this, this I discourage you at my worst....Because, I had been buzzed that late evening, a thursday evening...I warned you, I did the worst because the next seconds the only thing I could remember was that I being heralded punches left and right by two males.

Ended on the ground, pretty much, got a good beating.

Got home, etc.

The following morning, I woke up bruised and in a bad humor. I was in the worst of spirits, this is where my sensibilities failed me. ..

For I, went walking over to starbucks, ordered water only. Headed back out and sat in the patio. THE FIRST thing I see directly across from me is an UNCHAINED BIKE. I didn't care for the world. I walked over and pressed my feet on the pedals and wheeled away until I got caught, in less than 2 mins after committing such savage act, that I regret this horrible mistake.

It was mistake before the fact of being stupid. There's no way of altering or changing that back in any other way.

The first thing I remember after being picked up from the ground in cuffs was apologizing to the older man I had taken the bike.

And please learn to listen to the whole story before thinking I'm about sympathy. I've seen the lot of some of you treat each disgracefully, if sympathy is any blessing I count to restore my conscious, it will be from GOD and GOD ONLY.

That said, I came for any "legal" advice anyone could provide in courteous assistance.

You came to the wrong place for "legal" advice, we're not lawyers but I literally was at toys r us last week looking at bikes I seem GROWN ASS Mens bikes for $80.00 and they were nice! P.S. try getting a car.. You can get one for under 1K if you know how to look and it'll run like a champion
