Okay so I applied for the FAFSA to my school as a "Non-Eligible-Non-Citizen, they sent me a letter saying that they would qualify me as a legal resident for tuition purposes? Than I called them to clarify this, told them I was not a legal resident, and they asked me to send whatever Immigration documents I had, and to not worry about it, so I sent them my work permit, and my DACA letter, just a week ago it says online that I will be recieving a total of 6,000.....3,000 on federal pell grant, and 2,000 on federal loans? should I try to clarify this or should I just let them do their thing? I called them like 3 times about this already, but they keep telling me to not worry. I am in texas btw, and the university im going to doesnt file the TAFSA, they told me to file the FAFSA, even if I wasnt a resident, however I did sign that affidavit saying I will seek legal status when possible

Talk to a lawyer...you don't want this to affect you later down the road when you try to fix your status. We don't qualify for federal aid.

I just think there's a gray area, of us qualifying or not... I'm just keeping the emails i sent the university telling them I was not eligible for it, because of my legal status that should suffice as proof in the future if anything comes up?

It's like going to vote...only citizens can. However, you will get in a problem if you do. The state sent me the voting papers. No way I am voting.

I know it's hard to just turn down $6000 dollars when tuition is so expensive, but I think it is in your best interest. Good luck!

I think if the money is used, irregardless of what evidence you have, you can be denied adjustment under current law specifically as it relates to the Pell grant.

I would not take that money. I would call them and make absolutely clear that you are not a citizen nor an eligible non-citizen and that you want to withdraw / cancel the federal money.

You are committing perjury if you take the money. The penalty for perjury includes up to 5 years in prison, which would make it a felony under USCIS (any sentence w/ over 1 year in prison is considered felony for immigration purposes).

Technically you committed perjury when you claimed that you are eligible non-citizen (there is no such thing as non-eligible-non-citizen for FAFSA), but as long as you can prove that it was a mistake you still have a fighting chance.

Felony would precludes you from DACA and the future DREAM Act legislation.

Do not wait, you have to take the initiative and clear things up.

Hope that did not scare you, but you still have time to fix it before it's too late.
