If she files a year later she will still be granted only conditional PR only.

She must have been married for over two years prior to applying to get a 10 yr card. This also goes for investors I believe.

It's better to apply as soon as possible in almost every situation.

The process is roughly the same. You apply however for another waiver or something of that sort and might have to back to your country to pick up the visa.

This doesn't mean that you have to leave the country for a long time(you're not barred). Assuming the marriage is to a USC the recent law allows you to do it smoothly in the states. I think the leave is to remove your previous unlawful entry and allow you to enter legally. You're required to pick up the visa in another country only for that purpose because of the recent law that made this easier for marriages. While making it easier they also created the conditional permanent residence though not long ago.

If you marry a PR AND you do not have an i245 then I think that really gets messy and you might have to leave the country in only that instance but I'm not sure if there is a waiver in that instance or if you would be barred.

Are you planning on getting married soon?

I went and found this brief article that mentions this:

Thanks for the input I'm actually married to USC I'm planning on starting my paperwork in the next few months god willing. Hopefully it's much smoother since I'm daca approved now.
