Yes you can open a firm. Yes, you can purchase a firm. The most difficult step is financing, and since you're paying cash for the business there's no issue.

What kind of construction, and what type of business? Construction firms have to be treated extra diligently.

I have had two businesses since 2010. I was able to register them with the IRS and the State Department (Minnesota) with my ITIN. I know that since its a food business more than likely you would need a food handling permit? Not sure what its called but with your DACA approved it shouldn't be a problem and since you're paying Cash its way better since Banks are kind of weird giving out business loans to DACA recipients
