They look at various factors, if you apply the day after your marriage and somewhere along the process you get a really picky and strict interviewer, it could delay the process. This person may ask for more evidence and may even ask for a stokes interview and drag the process. At the end if the day is luck, the process might be fast and the interviewer great or the process could be a little longer and the interviewer really picky. There are a lot of factors, there are many marriages out there that are legit, with kids and everything and yet they are sometime asked to do a second interview. She is right in taking her time and making sure she has everything, a REF will obviously make the process be a but longer and delay by a few weeks to a month.

I have heard of cases where the marriage is 100% legit and they don't pass interview and the non citizen gets deported.

The same way they handle straight marriages..lol...I am in the process of adjusting my status..I have only been married legally since 7/13..my lawyer says if u are married under 2 yrs u get a provisional green card for 2 yrs then at 2 yrs u apply to get the restrictions lifted and then u get your 10 yr green card..

What difference does it make?? If your marriage is 100% legitimate it doesn't matter how picky or how much of an ass hole the interviewer is, nothing is going to happen.. They can ask and throw every question at you and show up to your door at 2 in the morning, if your marriage is legitimate none of this matters.. You have nothing to worry about. I know when I get married to my gf of many years now, she will petition for me the second we get our marriage license and it doesn't matter what an interviewer speculates why we're applying so early, none of your god damn business, do what you have to do to make sure everything on our part is legit and we will prove it is..

OP, if you have a brain, don't sit there thinking things are gonna go wrong.. If your shits legit.. Go through with it.. Don't waste time.

That's complete bull shit.. What the hell you think this is? Mexico? If the interviewer got beef with your hair they deport you? They have to prove beyond a reasonable doubt that your marriage is fraudulent and not only do you get deported but you get jail time.

Anyone who gets deported either had a criminal record or really we're commuting fraud. Don't believe that bull shit it was real and we got deported.. It's like murderers in jail claiming they're innocent.. Come on now..

I'm not worried about evidence we've been together since we were 16 so I have a lot of evidence to show, I just want to get daca and be able to work and show we meet the financial requirements too... 2 incomes are better than one. I'd much rather take my time and see a lawyer and know my options because I don't want to jump into it blind and risk it.

I don't think compromising on doing it without a lawyer should be an option, you need a lawyer for stuff like that but the income thing, can't you get someone to sponsor like a family member?

I don't remember what the requirements are, but I know we don't meet the required income for 3 people in our family, I could get someone to sponsor us, his whole family are USC. But I guess I just want to do it on our own, his mom gave me
A lot of shit when we first started dating saying I was only after him for a green card... Cus that's what happened to her, keep in mind I was only 16.
