Deffered act question

Hi I have a question, I am a legal immigrant petition by my dad who is not a natural citizen I am a dependent on a visa. Renewing it every three years till my priority date becomes current granting me. Green card. I am in college in NYC and it pains me to see the struggle of my parents paying my tuition because I couldn't work till I get my greencard it has been 7 years. And still waiting, and I have heared that some people who are legal status waiting for greencard benefited. For the DACA ACT is it possible for me to apply and benefit for it without voiding my change of status? I wanna help my parents.. And it would be nice to work without telling them I have no social security.... It feels like I am undocumented myself only the difference is I am paying a lot of money to make myself legal and unable to help my family. My parents earn less but we are trying to strive in the. Hopes of achieving that American dream.

Is it possible having both? While waiting for my green card? I would like some clear answers before I get an attorney I came to United States when I was still 11 years old June 2008 . I renew my visa every here years but unable to work

For you to apply for DACA you must be out-of-status (illegal) in the US on or before June 15 of 2012.

But you say you have a current visa right? I would talk with a lawyer about switching to a student visa (with the ability to work). Otherwise, if you are legal then you can't qualify for DACA.

My friend who was legal got a letter saying he qualified he got approved by the DACA but I'm afraid it will void the hardwork my parents planted for me to sow

Applying for DACA will not void any pending Green Card applications.

To qualify, you have to be out-of-status, meaning you are illegal in the country, on or before June 15, 2012.

If you are still legal, there is no use waiting for your visa to expire, because you would not qualify for DACA because you became illegal after June 15 of 2012.

I'm assuming you have the V-nonimmigrant visa, and correct me if I'm wrong. You cannot work under this visa?

if your visa is current, then no you cannot apply. However, maybe once its time to renew it, you can just not renew it and apply for DACA?

Extremely unlikely, one of core requirements of DACA is to be out of status as of June 15th 2012. Your friend is legal now while under DACA, are you sure he was beforehand?

My own guess being that he has an H-4 visa or possibly J-2. V visas haven't been issued in years (were only granted to people who had F2A petitions pending for more than 3 years, and the petition was filed before December 21st 2000). Children on dependent visas cannot work.

Even if he were to purposefully fall out of status he would not be eligible. DACA requires one to be out of status as of June 15th 2012. Not to mention that falling out of status for more than 180 days would make him ineligible to adjust status as a derivative on employment sponsorship. (Under 180 days you fall under what is known as 245(k)).

even if you were to become illegal trying to apply for daca; your 2008 entry doesn't qualify you for 5 years continued presence to June 15 2012 anyway.

since you are in school, i assume a college. couldn't you apply for work-study program in your school? depending on certain job criteria but most of them pay higher than minimum wage.
