Back in US after travelling with Advance Parole with deferred action - Page 8

Hi everyone,

I'll be requesting my advance parole pretty soon for humanitarian reasons. My grandmother has been very sick and this would be my first time visiting her in almost 8 years.
I entered the US when I was 14 with a tourist Visa and I've lived here ever since, now I'm 21 and I was approved for DACA.
Do any of you know since I overstayed my tourist Visa, would I still get the 10 year ban when I come back from visiting my grandmother?

Leaving on advance parole does not trigger the 10 year ban. The fact you originally entered on a tourist visa is irrelevant.

well I got my AP request approved today. Im nervous about the trip. EEEEEK. Going to visit my grandmother. Flying to Mexico city then smaller airplane to another small city. Leaving Monday or Tuesday. Thank you OP, i got some guidance from you.

I just wanted to share my experience with travelling on advance parole....
I was wondering if you have sent in your application for Adjustment of Status since its been since May. If you have, how is it going? I am in your exact same situation, except that I am only now applying for AP based on educational purposes but I hope to apply for AOS through my husband (US citizen ) of 3 years when I get back. I'd appreciate updates please

Hi people,

I just got back from going to Mexico a couple of weeks and did not have any issues getting back using advance parole. Came through Houston international airport and the only thing is that I had to wait like three hours to get my advance parole document stamped. I have a pending I-130 through my husband who is a USC and plan to apply for adjustment of status once that gets approved. Let me know if any of you are in the process of applying for adjustment of status after AP so we can help each other out.

Approved advance parole thru daca on dec 11, it's dec 18 and still haven't received it. Called to check the status and states that a I-797 form was sent out? Does that include travel document? Parole doc?

Any idea why you waited so long in the waiting room? Was there a lot of International Planes landing at the same time? Or what was the reason for this? Any idea? Thanks

Yes, there were a lot of international flights coming in and they had a lot of people waiting.

Hey Kelizabeth I was curious if you were planning on applying for AOS after coming back with advance parole and if you have acquired more than 180 days of unlawful presence since you were 18 years old? I talked to a lawyer 2 days ago and she explained to me that even after coming back with advance parole I would still be found "inadmissible" because of accrued unlawful presence and if i filed the i-485 to adjust status it would be denied because i accrued all that unlawful presence time. It seemed like the only way around that was to apply for the 601 waiver to waive the unlawful time accrued. Did you hear otherwise from any lawyer you talked to?

This is exact thing that I am worried about. My lawyer never said that I would be inadmissible but said the following this morning through e-mail.

"My recommendation is not to travel outside of the U.S. I discussed it with Mr. DiRaimondo as well, and he agrees. There are other issues involved besides whether you are physically allowed back into the U.S., and it is not worth taking the chance and jeopardizing your future ability to obtain lawful permanent residence (green card) should the opportunity arise. "

Not sure what to think at all know about traveling for work purposes to Brazil. "
